These Terms & Conditions ("Terms") govern your use of maximzocktatelier.pro and purchases from MaximZockt Atelier Handels GmbH ("we", "us", "MaximZockt Atelier"). By placing an order, you agree to these Terms. Austrian consumer protection law applies, including the Consumer Protection Act (Konsumentenschutzgesetz, KSchG) and the Distance and Off-Premises Contracts Act (Fern- und Auswärtsgeschäfte-Gesetz, FAGG).

1. Products and Prices

All prices are displayed in Euros (EUR) and include Austrian VAT (Umsatzsteuer) at the applicable rate. Product descriptions and images are provided for illustration; minor variations in colour or texture due to natural materials and handcrafted production are not considered defects.

2. Ordering Process

To place an order, add products to your cart and submit the checkout form with your email address. This constitutes a binding offer. We will confirm your order by email — the contract is formed upon our confirmation. No online payment is collected at checkout; we will contact you to arrange payment (bank transfer or other agreed method) and delivery.

3. Payment

Payment terms will be communicated in your order confirmation. Unless otherwise agreed, payment is due before dispatch. We reserve the right to cancel orders if payment is not received within the stated period.

4. Delivery

We deliver within Austria and the EU. Estimated delivery times are 3–7 business days after payment confirmation for Austria, and 5–12 business days for other EU destinations, unless otherwise stated. Delivery costs, if any, will be communicated before you confirm your order. Risk of loss passes to you upon delivery to the address provided.

5. Right of Withdrawal (Widerrufsrecht)

As a consumer within the meaning of the KSchG, you have the right to withdraw from a distance contract within 14 days without giving any reason, in accordance with § 11 FAGG.

The withdrawal period expires 14 days after the day on which you, or a third party nominated by you (other than the carrier), acquire physical possession of the goods.

To exercise your right of withdrawal, inform us by email at kontakt@maximzocktatelier.pro with a clear statement of your decision. You may use the model withdrawal form below, but it is not obligatory.

You must return the goods without undue delay and in any event no later than 14 days from the day you communicate your withdrawal. You bear the direct cost of returning the goods. Goods must be returned in their original condition and packaging where reasonably possible.

We will reimburse all payments received from you, including delivery costs (except supplementary costs arising from your choice of a delivery method other than our standard option), without undue delay and in any event no later than 14 days from receipt of the returned goods.

6. Warranty and Defects

Statutory warranty rights under the Austrian Consumer Warranty Act (Konsumentengewährleistungsgesetz) apply. For defects appearing within two years of delivery, you are entitled to repair, replacement, price reduction, or contract rescission in accordance with applicable law. Please report defects promptly to kontakt@maximzocktatelier.pro.

7. Liability

We are liable without limitation for intent and gross negligence, and for injury to life, body, or health. For slight negligence, we are liable only for breach of essential contractual obligations (Kardinalpflichten), limited to foreseeable, typical damage. This does not affect your statutory rights as a consumer.

8. Dispute Resolution

The European Commission provides an Online Dispute Resolution platform at ec.europa.eu/consumers/odr. We are not obliged or willing to participate in dispute resolution proceedings before a consumer arbitration board, unless required by law.

For Austrian consumers, the applicable courts are determined by your place of residence or our registered office in Graz, in accordance with Austrian civil procedure law.

9. Applicable Law

These Terms are governed by Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions of your country of residence remain unaffected where applicable under EU law.

10. Model Withdrawal Form
